De winstbestemmingseis voor de toepassing van de zorgvrijstelling is een statutaire eis
Op 19 januari 2022 heeft Rechtbank Zeeland-West-Brabant geoordeeld dat de winstbestemmingseis voor de toepassing van de zorgvrijstelling in de vennootschapsbelasting een statutair vereiste betreft en dat géén aanleiding bestaat om rekening te houden met de mogelijkheid tot statutenwijziging. Tevens oordeelt Rechtbank Zeeland-West-Brabant dat de status van de uiteindelijke aandeelhouders niet van belang is. Hiermee ontstaan de eerste scheuren in de muur van de recente beleidsbesluiten van de Staatssecretaris van Financiën met betrekking tot de zorgvrijstelling waarin wordt gesteld dat de winstbestemmingseis een statutaire én feitelijke toets betreft.
