Transfer Pricing disputes and resolution: are you ready?

In recent years we have seen transfer pricing audits increase in number and complexity. This scrutiny is resulting in complex multi-country tax disputes, with each country applying its own approach. KPMG’s Global Transfer Pricing Services professionals will share their insights and experiences in preventing and resolving these transfer pricing disputes. They will also discuss their recent experiences with unilateral and bilateral APAs and MAPs.

How to gain control of  Transfer Pricing?

Many multinationals struggle with the operational aspects of transfer pricing policies. This breakout session will focus on the implementation phase of the transfer pricing lifecycle, i.e. making, reporting and booking transfer pricing calculations, process monitoring and how technology can help in this respect. Participants will have the opportunity to share their struggles and experiences in this area and ask questions. KPMG will share practical experiences and our approach to operational transfer pricing and implementing effective controls within your organization.

Application of Value Chain Analysis (VCA)

Multinational enterprises (MNEs) are increasingly coming under scrutiny by local tax authorities with regard to their transfer pricing arrangements. Local tax authorities are focusing on the big picture, i.e. where do the local operations fit in a broader perspective of the MNE as a whole. This comes up in tax audits and Mutual Agreement Procedures (MAPs), and such an overview is also often required when requesting upfront certainty through Bilateral Advance Pricing Agreements (BAPAs). Additionally, MNE business models are changing, for example, through digitization. A Value Chain Analysis (VCA) is a way to get on top of all these TP issues. This breakout session will discuss the application of the VCA methodology and present the KPMG tool for this. 

Financial  Transactions in a changing world

This breakout session will focus on recent developments with respect to the transfer pricing of financial transactions. We will discuss the LIBOR transition, negative interest rates, Covid-19 related issues, recent case law and more generally the related guidance in the new Chapter X of the OECD Guidelines. We will also briefly share some recent experiences regarding (business/ IP) valuations. Our colleagues from Meijburg Legal will also be present at this session to discuss the broader legal aspects of the relevant financial transactions.
